Terms of Use

1. Agreement and eligibility

By downloading, installing, accessing, or using Whimlumi, you agree to these terms. If you do not agree, do not use the app or website. If you are not legally able to agree on your own, use Whimlumi only with authorization from a parent, guardian, or other person permitted by applicable law.

Apple’s or Microsoft’s store terms may give you additional rights or impose additional requirements. Where mandatory law or store terms control, they take precedence to that extent.

2. License to use Whimlumi

Rui Hu grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on compatible devices associated with the store account through which you acquired it, subject to these terms and the applicable store rules.

You may not sell, sublicense, rent, distribute, copy beyond permitted backups, circumvent access controls, interfere with the app, use it unlawfully, or reverse engineer it except to the extent a restriction is prohibited by applicable law.

3. The app and local data

Whimlumi is a desktop companion with movement modes, focus tools, a local garden, customization, and optional Plus content. The app is local-first: progress, preferences, and similar state are stored on your computer and are not backed up or synced by a Whimlumi-operated cloud service.

You are responsible for your device, operating-system account, backups, and local data. Removing the app, clearing its data, reinstalling the operating system, or changing devices may remove local progress. Store purchase restoration does not necessarily restore local garden or customization progress.

4. Free features, Plus, trials, and renewal

The core app is offered without a time limit. Whimlumi Plus unlocks additional forms, glows, and accessories through monthly or yearly auto-renewing subscriptions when offered by your store. Features, price, currency, tax, trial eligibility, and renewal date shown by the storefront at purchase control your transaction.

Only the yearly plan is intended to have an introductory trial. An eligible Mac subscriber may receive 14 days. Windows Plus and its planned one-month annual introductory offer are not currently available; both await Microsoft certification, approval, and publication. Monthly Plus has no introductory trial and is charged when purchased. Introductory offers are limited by the store’s eligibility rules and may not be available to every customer or in every region.

Unless canceled, a paid subscription renews automatically for the period shown by the store. Manage or cancel before renewal in the Apple or Microsoft account used to subscribe. Deleting Whimlumi does not cancel a subscription. Mac and Windows subscriptions are separate and do not transfer between stores.

5. Updates and availability

Whimlumi may change, add, improve, or retire features and content over time. We aim to preserve the useful core experience, but we do not promise that every feature, character, glow, accessory, operating-system version, or store offering will always remain available. Maintenance, security issues, platform changes, or events outside our control may interrupt availability.

6. Ownership and feedback

Whimlumi, including its software, artwork, characters, names, design, text, and other content, is owned by Rui Hu or the relevant licensors and is protected by applicable intellectual-property laws. These terms do not transfer ownership to you.

If you voluntarily send ideas or feedback, you allow us to use them to improve Whimlumi without a payment obligation, while you retain ownership of any rights you already hold.

7. Acceptable use

Do not use Whimlumi or this website to violate law, infringe another person’s rights, distribute malware, bypass store payment or entitlement systems, probe for vulnerabilities without authorization, or disrupt the app, website, stores, or related services.

8. Disclaimers

To the maximum extent permitted by applicable law, Whimlumi is provided “as is” and “as available,” without warranties not expressly required by law. Whimlumi is a general productivity and entertainment app; it is not medical, mental-health, emergency, financial, or professional advice.

Nothing in these terms excludes statutory warranties, consumer guarantees, or other rights that cannot lawfully be excluded.

9. Limits of liability

To the maximum extent permitted by law, Rui Hu will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost data, profit, opportunity, or goodwill arising from Whimlumi. Where liability cannot be excluded, it is limited only to the extent the law permits.

Some places do not allow particular exclusions or limits, so parts of this section may not apply to you.

10. Ending use

You may stop using and uninstall Whimlumi at any time. You must separately cancel any active subscription through the applicable store. We may suspend access to future app services or updates for material misuse or violation of these terms, subject to applicable law and store rules.

11. Applicable law and changes

Applicable law, including mandatory consumer protections where you live, governs these terms. Before starting a formal dispute, please contact us so we can try to resolve the issue. Nothing here prevents either party from using rights or remedies available under applicable law.

We may update these terms to reflect product, store, security, or legal changes. The effective date identifies the current version. If a change materially affects your rights, we will provide notice through the app, website, or store listing when appropriate. Continuing to use Whimlumi after an update takes effect means you accept the updated terms to the extent allowed by law.
